1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the website, mobile app / booking platform, and physical facility operated by The Draw Golf Lounge, LLC (“The Draw,” “we,” “us,” or “our”), located in North Peoria, Arizona (collectively, the “Services”). By creating an account, booking a session, purchasing a membership, or visiting our facility, you agree to be bound by these Terms, our Privacy Policy, and (before your first visit) our liability waiver. If you do not agree, do not use the Services.
2. Description of Service
The Draw is a 24/7 automated, unstaffed indoor golf simulator lounge offering bay rentals to members and walk-in (non-member) customers, along with leagues, tournaments, and lessons. Bookings, account management, and facility door access are all handled through our booking platform (USchedule).
3. Eligibility; Age Requirements
You must be at least 18 years old to create an account or hold a membership. Minors may enter the facility only as a guest of an adult member's reservation, accompanied by a parent or guardian, and are subject to the minor-specific section of our liability waiver, which requires the parent or guardian's presence and agreement to additional terms. By creating an account, you represent that the information you provide is accurate and that you meet these eligibility requirements.
4. Account Registration; Booking Platform
You must register an account through our booking platform to reserve a bay, hold a membership, or receive app-controlled door access. You are responsible for maintaining the confidentiality of your login credentials and door-access code, and for all activity under your account. Notify us promptly of any unauthorized use of your account or access credentials.
5. Membership Plans; Billing
5.1 Membership Tiers
We offer several membership tiers (Daytime, Starter, Core, Pro, Founding, and Corporate), each with different access hours, tee-time length, advance booking window, and guest allowances, as described on our website and in your membership confirmation. All tiers include unlimited play within their respective access windows.
5.2 Recurring Billing and Payment Authorization
Monthly and annual memberships bill automatically to your payment method on file at the start of each billing cycle. By enrolling, you authorize us (and our payment processor, Stripe) to charge your payment method on a recurring basis until you cancel in accordance with Section 5.5.
5.3 Founding Member Rate Lock
Founding Members who enroll during the pre-launch period receive a lifetime rate lock on their Founding membership rate, which will not increase for as long as that membership remains active and in good standing, subject to the Founding Member program terms in effect at signup.
5.4 Price Changes
We may change membership pricing for new enrollments or upon renewal of non-Founding memberships, with reasonable advance notice to affected members.
5.5 Cancellation, Upgrades, and Downgrades of Membership
Month-to-month memberships may be cancelled at any time effective at the end of the current billing cycle. Annual (12-month commitment) memberships may not be cancelled before the end of the committed term, except as required by law. You may request a tier upgrade or downgrade through the booking platform, effective at the start of the next billing cycle unless otherwise stated.
6. Booking, Access, and Facility Use
6.1 Booking Windows and Reservation Limits
Each membership tier has its own advance booking window (from 1 week up to 21 days) and simultaneous-reservation limit, as described on our pricing page. Walk-in (non-member) bookings are subject to availability.
6.2 Guest Policy
Each tier includes a set number of free guests per session (0–4, depending on tier); a walk-in booking allows up to 4 guests to share a bay at no additional charge. Guests beyond a member's free allowance are billed at $20/hour/person. Members are responsible for their guests' compliance with these Terms and all facility rules. Guests under 18 must be accompanied by a parent or guardian and are subject to the minor-specific terms of our liability waiver (see Section 3).
6.3 Overage and Non-Member Hourly Rates
Time booked beyond a membership tier's included tee-time length bills at the prevailing walk-in rate less 10%. Non-member (walk-in) bay rentals bill at the blended hourly rate in effect at the time of booking, which varies by time of day and, during the summer season (June–September), by seasonal peak pricing.
6.4 24/7 Access; Door Codes and App Access
Facility access is granted through the booking app via your account, which controls door entry for your reserved session. You may not share your access credentials with anyone who is not your registered guest for that session, and you may not admit individuals who are not part of your reservation.
6.5 Cancellation and No-Show Policy
Bay reservations that carry a charge (including walk-in bookings, guest fees, and overage hours) are charged in full at the time of booking. You may cancel or reschedule your reservation up to 1 hour before your scheduled tee time for a full refund. Cancellations made less than 1 hour before your scheduled tee time, and failure to arrive for a reserved session (a “no-show”), are non-refundable.
6.6 Facility Rules; Prohibited Conduct
You agree to use the facility and equipment only as intended, to leave each bay in reasonable condition for the next guest, and not to engage in conduct that is unsafe, damaging to Company property, or disruptive to other members. We may suspend or terminate access for violations of these Terms or facility rules.
6.7 Equipment Care; Damage Liability
You are responsible for the reasonable care of simulator equipment, clubs (if provided), and facility furnishings during your session, and may be charged for damage beyond normal wear and tear caused by misuse or violation of posted facility guidelines.
6.8 Video Surveillance Acknowledgment
The facility is monitored by security cameras that record both audio and video, as described in our Privacy Policy. By entering the facility, you consent to this audio and video recording.
7. Liability Waiver; Assumption of Risk
Before your first visit, you must review and electronically or physically sign our liability waiver and assumption-of-risk agreement, which is incorporated into these Terms by reference. Golf and simulator use carry inherent risks, and by using the facility you assume those risks as described in that waiver. If there is a conflict between these Terms and the waiver regarding assumption of risk or liability, the waiver controls as to those subjects.
8. Corporate Accounts
Corporate memberships permit the primary account holder to designate up to four named employees authorized to use the account, subject to the 21-day advance booking window and other Corporate tier terms. Corporate accounts may elect invoiced billing on net-30 terms where available. The primary account holder is responsible for all charges and for its named employees' compliance with these Terms.
9. Leagues, Tournaments, and Lessons
Leagues and quarterly tournaments are open to eligible membership tiers as described on our website, with scores tracked through our Simulator Golf Tour (SGT) integration. Private and group lessons are offered by an independent-contractor PGA professional who is not an employee of The Draw; the professional sets their own instructional terms, and bookings are made through our booking platform.
10. Intellectual Property
The Draw's name, logo, and the content of our website and app are owned by The Draw Golf Lounge, LLC or its licensors and may not be used without our prior written consent, except as necessary to use the Services as intended.
11. Termination
We may suspend or terminate your account or facility access for violation of these Terms, non-payment, or conduct that threatens the safety of others or our property. You may terminate your membership as described in Section 5.5.
12. Disclaimers; Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DRAW'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE DRAW IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold The Draw harmless from claims, damages, and expenses arising out of your violation of these Terms, misuse of the facility, or your guests' conduct, except to the extent caused by The Draw's own negligence or willful misconduct.
14. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles.
15. Changes to These Terms; Contact Us
We may update these Terms from time to time. We will post the updated version on our website with a new “Last Updated” date, and material changes will be communicated to active members through the booking platform or by e-mail.
