1. Introduction and Scope

The Draw Golf Lounge, LLC (“The Draw,” “we,” “us,” or “our”) operates a 24/7 automated indoor golf simulator lounge in North Peoria, Arizona, together with an associated website, mobile app / booking platform, and in-person facility (collectively, the “Services”). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices available to you. By visiting our website, using our app or booking platform, or visiting our facility, you acknowledge the practices described in this Policy.

2. Information We Collect

2.1  Information You Provide to Us

2.2  Information Collected Automatically

2.3  Information Collected at the Facility

3. How We Use Your Information

4. How We Share Your Information

We do not sell your personal information. We share personal information only as follows:

5. Video Surveillance

Because The Draw operates as a 24/7 unstaffed facility, we use security cameras in common areas and bays to protect the safety of members and guests, deter and investigate theft or property damage, and resolve disputes about facility use. Camera footage includes both video and audio and is retained for approximately 30 days before being automatically deleted, except where footage is preserved longer in connection with an active investigation, insurance claim, or legal proceeding. Footage is accessible only to authorized personnel and, where necessary, our security-monitoring vendor, law enforcement, or our insurer. By entering the facility, you consent to this audio and video recording, consistent with the acknowledgment in our liability waiver.

6. Marketing Communications; SMS and E-Mail Consent

We seek separate, affirmative consent for e-mail marketing and for SMS/text marketing — checking one does not opt you into the other. If you opt in to SMS marketing:

Regardless of your marketing preferences, we may still send you transactional messages (e.g., booking confirmations, billing notices, and service-related alerts) necessary to operate your membership.

7. Cookies and Similar Technologies

Our website and booking platform may use cookies and similar technologies to keep you logged in, remember your preferences, and understand how visitors use our site. You can control cookies through your browser settings; disabling cookies may limit some site functionality.

8. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with our legal and tax obligations (including Arizona TPT recordkeeping), resolve disputes, and enforce our agreements. Video surveillance footage is subject to the shorter retention period described in Section 5.

9. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including relying on our service providers' security measures for payment processing, booking, and access control. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your Choices and Rights

You may request access to, correction of, or deletion of your personal information, or ask us to stop sending marketing communications, by contacting us using the information in Section 13. We will respond to reasonable, verified requests. This Policy is written for our current Arizona-based operations; if we later begin knowingly serving customers in states with additional statutory privacy rights (e.g., California, Colorado), we will update this section accordingly.

11. Children's Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 online. Minors may attend the facility only as a guest of an adult member's booking, accompanied by a parent or guardian — see our Terms of Service for our facility age policy.

12. Corporate Account Data

For Corporate memberships, the primary account holder is responsible for providing accurate contact information for up to four named employees and for informing them that their name, contact information, and facility usage may be visible to the account administrator and to The Draw for invoicing and account-management purposes.

13. Changes to This Policy; Contact Us

We may update this Privacy Policy from time to time. We will post the updated version on our website with a new “Last Updated” date, and, for material changes, provide additional notice as appropriate.
